Home Foreclosure

Stop Home Foreclosure

With the recent downturn in the economy, home foreclosures are at record highs. If you are at risk of losing your home to foreclosure, protect your rights by speaking with an attorney as soon as possible.

For help in northern Indiana, contact the experienced bankruptcy and debt relief team at Golden Law, PC. Based in Fort Wayne, Indiana, our law firm has helped more than a thousand clients find solutions to difficult debt challenges.

Chapter 13 Bankruptcy

One of the most common ways that we help clients who wish to keep their home and avoid foreclosure is through a Chapter 13 bankruptcy. From the moment we file for Chapter 13 on your behalf with a bankruptcy court, an automatic stay is created that will put a temporary halt on further creditor collection efforts, including a home foreclosure. Even if your bank has started the process of foreclosure, we can help.

If retained to handle your case, we will file all necessary paperwork with the court requesting a three to five year payment plan that will allow you to pay your mortgage arrears gradually over time, and without costly late penalties or interest. Depending on the facts of your case, you may even be able to discharge a second home mortgage. Visit our bankruptcy FAQ page to learn more.

Chapter 7 bankruptcy

If you are unable to make further home payments, your mortgage lender may pursue a foreclosure action and sell your home. If the proceeds from the bank sale are not sufficient to pay your remaining mortgage debt, the bank may attempt to collect the deficiency from you, which is often tens of thousands of dollars. Through a Chapter 7 bankruptcy, we can help you discharge a foreclosure deficiency.
